1. Acceptance of Terms

By registering for an account, subscribing to a premium tier, or accessing the HypePing dashboard, you agree to be bound by these Terms of Service. If you do not agree, you may not use the service.

2. Subscriptions, Billing & Refunds

HypePing is a paid Software-as-a-Service (SaaS). By subscribing, you agree to recurring monthly billing via our payment processor, Stripe.

  • Cancellations: You are responsible for managing your own subscription. You may cancel at any time through the billing portal located directly within your dashboard. You will retain access to the premium features until the end of your current billing cycle.
  • Digital Goods Exemption (No Refunds): By subscribing, you are granted immediate access to a digital analytics dashboard and proprietary historical data. Because this access is granted instantly and cannot be returned, all sales are final and strictly non-refundable. We do not offer prorated refunds for canceled subscriptions, nor do we provide refunds for accounts that were unused or "forgotten" prior to cancellation.
  • Fraudulent Chargebacks: Any fraudulent chargebacks or payment disputes initiated with your bank or credit card provider will result in the immediate and permanent termination of your account. We actively monitor and dispute all unauthorized chargebacks by providing Stripe and your banking institution with these Terms of Service, your IP address, and detailed server access logs verifying your usage of the digital goods.

3. Acceptable Use & Account Sharing

You agree not to misuse the service. Attempting to reverse-engineer the HypePing API, scrape our databases, or automate requests to our servers is strictly prohibited. Furthermore, account sharing is forbidden. Sharing a single paid account across multiple users or an entire agency violates our licensing and will result in immediate account termination without refund. Agencies must purchase the appropriate Agency Tier to cover their operations.

4. Twitch TOS Compliance

HypePing utilizes the Twitch API to track public engagement data. By using our service and the integrated VOD clipper, you also agree to be bound by the Twitch Terms of Service. We are not affiliated with, endorsed by, or sponsored by Twitch Interactive, Inc.

5. Disclaimer of Warranties

HypePing is provided "as-is" without warranty of any kind. While we strive for 99.9% uptime, we do not guarantee that the service will be entirely free of interruptions, delays, or API rate limits imposed by third parties (like Twitch).

6. Limitation of Liability

In no event shall HypePing, its founders, or its affiliates be liable for any indirect, incidental, or consequential damages, including loss of revenue, missed clipping opportunities, channel bans, or loss of data arising out of your use of the service.
